1. Overview

Lesuto Industries Corp (“Lesuto”) respects the intellectual property rights of others and expects users of Lesuto Disco (the “Service”) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), codified at 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the Service.

If you believe that content hosted on or accessible through the Service infringes your copyright, please submit a notification of claimed infringement as described below. Upon receipt of a valid DMCA takedown notice, we will remove or disable access to the allegedly infringing material and take reasonable steps to notify the user who posted it.

2. How to File a Takedown Notice

To file a DMCA takedown notice, send a written communication to our designated DMCA agent (listed above) that includes all of the following elements as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the Service (e.g., the URL of the track page).
  4. Information reasonably sufficient to permit us to contact you, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

3. Counter-Notification Process

If you believe that material you posted on the Service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our DMCA agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, Travis County, Texas), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and inform them that we will restore the removed material in 10 to 14 business days. If the original complainant does not file a court action seeking to restrain the user from infringing activity relating to the material within that period, we will restore the material.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Lesuto has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Generally, an account will be flagged after two valid DMCA takedown notices and may be terminated after three. We reserve the right to terminate accounts after a single infringement in egregious cases.

5. Good Faith

We handle all DMCA notices and counter-notices in good faith. We do not adjudicate copyright disputes between parties; our role is limited to processing notices in compliance with the DMCA. We encourage copyright owners and users to seek legal counsel if they have questions about their rights.

Filing a false DMCA takedown notice or counter-notification may result in legal liability. Before submitting a notice, please ensure that you have a good faith belief that the use of the material is not authorized and that your claim is accurate.
